All employees are required to be of sound mind while at work.
Good performance on the part of our employees is crucial to THE AVIATOR’s success. For this reason, we strictly forbid employees to do the following while at work*:
* including any part of Company property, company vehicles, and during work hours or meal break.
Furthermore, we strictly forbid the following during an individual’s employment with THE AVIATOR regardless of being clocked into work or not.
This includes consumption of marijuana or CBD products when you are not at work.
Safety-sensitive employees of THE AVIATOR are subject to mandatory, random drug testing and blood alcohol level testing in compliance with the Company’s Drug & Alcohol Abuse Prevention Program. The FAA is the regulatory body responsible for surveillance of all aviation connected activities including the activities of THE AVIATOR. As a federal agency, they uphold and adhere to all FEDERAL laws. Marijuana is currently listed as a Schedule 1 controlled substance according to federal law; therefore it is still considered an illegal drug for workers in the aviation industry. The testing performed for marijuana exposure can show a positive result as long as 4 months past the time of marijuana use.
Candidates for a safety-sensitive position at the Company must pass an initial drug test (which includes testing for marijuana exposure) before being offered employment at THE AVIATOR. For the entire duration of your employment with THE AVIATOR, no federal schedule 1 controlled substance may be in your system.
Accidental Exposure
Because we live in a state where marijuana is legal, we understand that accidental exposure is possible. If such an exposure should occur, you should immediately tell your supervisor that you suspect accidental exposure. The Company will send you for testing. If you test negative, you can continue your work as normal. If you test positive (in an accidental exposure, self-report incident), you will be placed on non-safety sensitive duty until you can test negative. We appreciate your honesty and integrity in keeping others safe.
If an employee experiences multiple accidental exposures, suspicion will be raised as to the circumstances leading to such “accidents”. Removing an employee from safety sensitive duty is costly for the Company and so is the additional testing required to fully resolve such a situation. If an individual repeatedly causes this productivity-diminishing circumstance, disciplinary action will be taken including requiring the employee to cover the cost of appropriate drug tests, unpaid leave, and up to and including termination of employment.
Failing a Drug or Alcohol Test
If an employee is suspected of being intoxicated at work or using illegal drugs or marijuana, he or she can be tested at any time at the discretion of the Company.
If an employee tests positive for drugs or alcohol, the following disciplinary action will be taken.
The employee will immediately be placed on unpaid leave. The employee will remain on unpaid leave until he or she can test negative on 3 consecutive drug and alcohol tests. The employee will pay for these tests him/herself. If the employee does not wish to pay for the appropriate testing, he or she may voluntarily resign from employment and would become ineligible for re-hire by the Company for 2 years. Once the employee has tested negative on 3 consecutive drug and alcohol tests, he or she may be eligible for re-hire with the company; however, the employee’s pay rate may be renegotiated at that time.
Failing subsequent drug and alcohol testing is grounds for immediate termination.
Note: If an employee’s misconduct related to drugs, marijuana, or alcohol is deemed especially grievous by the Company, the Company reserves the right to terminate his or employment immediately.
THE AVIATOR enforces a non-smoking policy for all employees.
We work at a facility that handles fuel and other hazardous materials. In the interest of safety for the entire airport, smoking at Atlantic Aviation, the Sadler Building Plaza, or any part of the Company’s property will be strictly prohibited for employees of The Aviator. This includes all parking lots, aprons, hangar space, and any work-away job site in its entirety. No smoking will be permitted in any of these areas whether the employee is safety-sensitive or non-safety sensitive, on or off duty, clocked in or clocked out. The term “smoking” includes use of cigarettes, cigars, pipes, vape pens, e-cigarettes, and all other oral smoking devices especially those that contain tobacco or marijuana.
Violation of this policy is grounds for immediate termination of employment with the Company.
